Miguel Eaton focuses his practice on complex ERISA litigation and employee benefits matters. He also has significant experience defending against claims under the federal Fair Credit Reporting Act. _x000D_

A significant portion of Miguel's practice involves multiemployer benefit and pension plans, including counseling contributing employers, litigating withdrawal liability and trustee deadlocks, as well as advising on M&A matters involving such plans. He also advises clients' benefit committees as they evaluate participants' claims for pension, health and welfare, and disability benefits. Miguel's litigation experience includes defending companies in stock drop cases, fiduciary duty class actions, and retiree health cutback cases, as well as companies being investigated by the Department of Labor and the Department of Justice. _x000D_

Miguel also has significant experience litigating employee benefits issues in bankruptcy. He was part of the team that represented the City of Detroit during its historic bankruptcy. More recently, he advised Alpha Natural Resources regarding pension and retiree health issues during its bankruptcy. _x000D_

Miguel's practice also includes pro bono work related to veterans. He represents service members who choose to appeal their disability ratings to their respective Physical Evaluation Boards and the U.S. Department of Veterans Affairs. He also has experience with disability appeals to the U.S. Court of Appeals for Veterans Claims and to the U.S. Court of Appeals for the Federal Circuit. _x000D_
